Local Government Electoral Act Changes


The Property Council has provided a submission to the Local Government Electoral (Implementing Stage 2 of Belcarra) and Other Legislation Amendment Bill 2019.

Within the submission, the Property Council has highlighted concerns relating to provisions that would impede the operations of local governments, without increasing transparency and integrity.

The Bill seeks to amend provisions relating to ‘major policy decisions’ that local government is prohibited from making during the caretaker period leading into council elections. Included in the amendments is the ability for councils to make decisions about variation requests and changes to variation approvals.

The Property Council has raised concerns that variations applications can be minor variations and therefore not meet the ‘major policy decision’ test and should be deferred by delegation to council officers for a decision.

The second area of concern relates to the proposed ‘prescribed conflict of interest provisions’ in the Bill.  The Property Council is concerned these provisions could stifle the decision-making processes of councils.

The Property Council has previously opposed the state government’s prohibited donor scheme, which excludes property developers, their close associates and spouses from making political donations.
